Exemptions from the Fair Labor Standards Act

Certain jobs are exempt from the Fair Labor Standards Act. For example, in the computer industry, computer systems analysts, computer programmers, and software engineers are all exempt.

However, the job titles can change quickly. In some cases, employers can choose to use nonexempt employees for these jobs.

For computer-related jobs, there are two types of exemptions: administrative and executive. The former applies to employees who are paid at least $455 a week and perform duties that are considered administrative.

The latter applies to employees who perform computer-related duties, such as planning, scheduling, and coordinating activities.

Compensation for overtime work

If you’ve been working overtime but aren’t being paid for it, you may be entitled to overtime pay. Overtime pay is required under employment laws if you work more than 40 hours a week.

Compensation for deferred compensation

Deferred compensation is a form of compensation that an employee earns during a particular year but does not receive until a later date. This includes deferred annual bonuses, deferred incentive compensation, and severance entitlements.

Deferred compensation is compensation that an employee will receive for a service or product after the service is completed. The right to receive the payment is contingent and conditional and the payment is only made after the service is performed.

While several states have enacted family and medical leave policies, few have passed permanent legislation that guarantees coverage for workers in all circumstances.

For example, only four states guarantee paid leave for serious medical conditions, and another four provide a two-week extension for pregnancy-related health issues.

Some states also provide a sliding scale that ensures that workers can get at least a certain percentage of their pay replaced during unpaid leave. Other states have limited or no coverage for self-employed workers and public sector employers may have to comply with a seven-day unpaid waiting period.

Another important issue for workers is paid leave. Paid family and medical leave help workers meet their personal health care needs.

The recent COVID-19 pandemic has made the need for such leave even more urgent. In response, Democratic lawmakers have introduced bills to create a national paid sick and family leave program.
